Privacy

I. General provisions

The controller of personal data under Article 4(7) of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data ("GDPR") is HERBAPORT s.r.o., company ID 19258046, registered office Pod Pekařkou 1089/33, Prague 4, 147 00, Czech Republic, entered in the Commercial Register of the Municipal Court in Prague, Section C, File 383809 (the "controller"). Personal data means any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person. The controller has not appointed a data protection officer.

II. Sources and categories of personal data

The controller processes the personal data you provide by completing and sending the contact form or by sending an e-mail: name, company, e-mail address, telephone number and the content of the message.

When you visit the website, the hosting provider records the IP address and time of access in the server's operating logs.

If you give your consent, data about your visit are processed through Google Analytics: pages visited, approximate location, type of device and browser. Without consent this service is not loaded and no cookies are stored.

III. Legal basis and purpose of processing

Data from the form or an e-mail are processed in order to handle your question or enquiry. The legal basis is taking steps at your request prior to entering into a contract under Article 6(1)(b) GDPR and the controller's legitimate interest in handling the enquiry under Article 6(1)(f) GDPR. An enquiry cannot be handled without a name and contact details.

Processing through Google Analytics serves to measure traffic and improve the website. The legal basis is your consent under Article 6(1)(a) GDPR.

The server's operating logs serve to keep the website secure and running. The legal basis is the controller's legitimate interest under Article 6(1)(f) GDPR.

IV. Cookies and Google Analytics

The website uses Google Analytics 4, a service of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. The service starts only after you click "Accept" in the consent bar. It then stores the cookies _ga and _ga_VX9G7FWTRX in your browser, valid for up to 2 years.

Your choice is stored in your browser for 12 months. You can withdraw or change your consent at any time through the "Cookies" link in the website footer. After withdrawal the measurement stops and the cookies of this service are deleted.

Google may also process the data on servers in the USA. The transfer relies on the European Commission's adequacy decision (EU-U.S. Data Privacy Framework).

The website uses no other cookies.

V. Recipients of personal data

The recipients of personal data are the provider of web hosting and e-mail services (ACTIVE 24, s.r.o.) and, if you give your consent, the provider of Google Analytics.

VI. Storage period

The controller stores personal data for the time needed to handle the enquiry and to exercise the rights and obligations arising from the contractual relationship between you and the controller and to assert claims from that relationship, for no longer than five years.

After the storage period has expired, the controller deletes the personal data.

Data in Google Analytics are stored for no longer than 14 months.

VII. Your rights

Under the conditions laid down in the GDPR you have the right of access to your personal data under Article 15 GDPR, the right to rectification under Article 16 GDPR or to restriction of processing under Article 18 GDPR, the right to erasure under Article 17 GDPR, the right to object to processing under Article 21 GDPR and the right to data portability under Article 20 GDPR. You may withdraw consent you have given at any time, in writing or electronically, at the controller's address or e-mail stated in Section I.

You also have the right to lodge a complaint with the Czech Office for Personal Data Protection (www.uoou.cz) if you believe that your right to the protection of personal data has been infringed.

VIII. Security of personal data

The controller declares that it has taken all appropriate technical and organisational measures to secure personal data. The controller has taken technical measures to secure data storage and storage of personal data in paper form.

The controller declares that only persons authorised by it have access to personal data.

IX. Final provisions

By sending the contact form you confirm that you have read these privacy terms.

The controller is entitled to change these terms. It will publish the new version on its website.

These terms are valid from 6 October 2026.
